Buying a Waterfront Home in Panama City Beach: Seawalls
Find out what you are buying at the water's edge: the seawall's history, its condition and the rules that apply to your shoreline.
How do I find the seawall's history?
Look for paper trails before the inspection. Bay County's dock and seawall permit packet asks for a certified Notice of Commencement on jobs over $5,000. Bay County Form B36 The Clerk's free Official Records search covers documents recorded since January 1, 1987. Bay County Clerk records
On the Gulf County side, the Clerk links official records to the statewide myfloridacounty.com search. Gulf County Clerk records
- Ask the seller for permits, invoices, warranties and past seawall or bulkhead reports.
- Search the owner's name for a Notice of Commencement near the repair date.
- Note the contractor's name so you can check the license.
What does a home inspection leave out?
A standard home inspection may skip the wall. Florida's rules do not require inspectors to look at seawalls, boat lifts or docks. Rule 61-30.810, F.A.C. Book a separate seawall visit early.
Watch the clock. On the AS IS contract, the inspection period is 15 days if the blank is empty, and you may cancel in your sole discretion before it ends. FR/BAR AS IS Contract
Schedule the seawall visit in the first days of the inspection period. Reports and follow-up questions take time.
Should I take a credit or ask for a repair?
Compare any credit with a written scope for your wall. A number that leaves out permits, access or drainage is not a budget. The scope checklist shows what to look for.
The standard contract has its own exits. If repairs pass the seller's limit and you cannot agree within 5 days, either side can cancel. Both FR/BAR forms also include a separate 20-day flood-zone exit. FR/BAR contract forms

What this check is based on
The questions cover signs shown in the City of Holmes Beach seawall manual (pages 5–13): soil loss, wall movement, open joints and damaged concrete.
What to ask for in a seawall condition report
Confirm the type of assessment and written report with the professional you choose, including the scope and delivery date. Ask for dated photos, findings, recommended repairs and a list of areas that could not be inspected.
Ask whether the assessment covers the wall panels, concrete cap, joints, supports and ground behind the wall. Buried anchors and underwater areas may need extra investigation. If you need a repair budget or an estimate of remaining life, discuss that before the visit.
Request report pricing. Confirm the scope, price and availability directly with the professional before relying on a visit or report date.
See the InterNACHI waterfront inspection standard for examples of what a visual inspection covers.
Check the right wall measurement.

Common questions
Is a straight wall a sound wall?
Not always. Problems often start below the waterline or in the soil behind the wall, where you cannot see them.
Does an older wall need replacement?
Age alone does not decide it. Ask the specialist to tie any recommendation to what they found.
Can I use the seller's seawall report?
Check its date, scope and who may rely on it. Ask the author whether an update makes sense.
Will my flood policy pay if the wall fails?
Do not count on it. The standard federal flood policy ordinarily excludes seawalls, bulkheads, piers and docks. NFIP seawall exclusion
Who checks the contractor who did past work?
You can. Look up the license number on the invoice through the state license search. See how to verify a contractor.
What should I keep after closing?
Permits, reports, invoices, warranties and dated photos. They make the next repair or sale easier.
Ask the flood questions before you price the wall
The federal flood policy will not rebuild the wall. The current NFIP Dwelling Form excludes seawalls, retaining walls, bulkheads and docks. NFIP Dwelling Form
Ask for the seller's flood disclosure. Florida requires it at or before contract, covering known flood damage, flood insurance claims and FEMA aid during the seller's ownership. s. 689.302, F.S.

Some shorelines limit what you can build
Check where the lot sits before you plan a new wall or dock. The St. Andrews Aquatic Preserve covers the inlet area of St. Andrew Bay, and St. Joseph Bay is a preserve too. St. Andrews Aquatic Preserve St. Joseph Bay Aquatic Preserve Inside a preserve, no new seawall may be built waterward of mean high water. Restoring a wall in place, or up to 1 foot waterward, needs no application for consent of use. Rule 18-20.004(1)(c), F.A.C. Rule 18-20.004(1)(e)7, F.A.C.
- Preserve docks: main walkway up to 4 feet wide, reaching no farther than 4 feet deep at mean low water, terminal platform up to 160 square feet. Rule 18-20.004(5), F.A.C.
- Gulf County coast: the comprehensive plan prohibits new vertical seawalls in coastal areas. Gulf County Policy 1.4.5
- Cape San Blas: parts lie in Coastal Barrier Resources System Unit P30, where federal flood insurance is limited. FWS CBRS Unit P30 FWS CBRS flood insurance rules
Read the Gulf County guide if you are buying on the bay or the cape.
Read the limits section of the report first
A report can say the cap looks sound and also say the anchors and the underwater face were not checked. Both can be true. Find out which open questions matter before you rely on the report.
- What was inspected, and how.
- What could not be reached or seen.
- Whether more investigation is recommended.
- Whether a repair scope depends on those unknowns.
Use the inspection period to get these answers. Then decide with your agent and attorney how to handle anything still open.
