Which contract clause puts the seawall in play?

Start with the form your clients signed. The Florida Realtors/Florida Bar standard Residential Contract lists seawalls, dockage and boat lifts as items the seller must keep in Working Condition until closing. It also lets a person who holds a Florida license to repair those items do the inspection. FR/BAR Residential Contract

The AS IS form is different. It does not mention seawalls, docks or bulkheads, and the buyer accepts the physical condition unless they cancel within the inspection period. That period is 15 days if the blank is left empty. FR/BAR AS IS Contract

On an AS IS deal, the seawall question has to be answered before the inspection period ends. After that, the buyer has accepted the wall as it stands.

What should the seawall specialist receive?

Confirm the permit office first. An address that says Panama City Beach is not always inside city limits. On the Bay County Property Appraiser record, city parcels show Tax Area 13. Panama City Beach jurisdiction check

Then send one short package:

  • The question your client needs answered and the wall segment involved.
  • Parcel number, survey and any earlier seawall, bulkhead or dock permits.
  • Repair invoices, past reports and photos, with missing records labeled as missing.
  • Gate codes, dock access and the person who can authorize entry.
  • The inspection-period end date and who receives the report.

For what a site visit usually covers, see the seawall assessment guide.

How do findings turn into repair numbers?

Under the standard contract, the seller's General Repair Limit defaults to 1.5% of the price, with a separate 1.5% limit for open or unpermitted work. If repairs exceed the limit and the parties do not agree within 5 days, either side may cancel. FR/BAR Residential Contract

That makes the report's wording matter. Ask the specialist to separate what was seen, what could not be reached and what needs more investigation. A visual report, an engineered repair design and a contractor's price answer different questions.

Use a written scope when the parties talk about credits. The cost guide and the repair-or-replace guide show what a complete scope should list.

What to ask for in a seawall condition report

Confirm the type of assessment and written report with the professional you choose, including the scope and delivery date. Ask for dated photos, findings, recommended repairs and a list of areas that could not be inspected.

Ask whether the assessment covers the wall panels, concrete cap, joints, supports and ground behind the wall. Buried anchors and underwater areas may need extra investigation. If you need a repair budget or an estimate of remaining life, discuss that before the visit.

Request report pricing. Confirm the scope, price and availability directly with the professional before relying on a visit or report date.

See the InterNACHI waterfront inspection standard for examples of what a visual inspection covers.

Check the right wall measurement.

Thinking about raising or replacing the wall? The height guide explains which survey measurement to use and where to check local requirements.

Common questions

Does the standard contract cover the dock and boat lift too?

Yes. Seawalls, dockage, watercraft lifts and related equipment sit together in the maintenance clause. Ask the specialist to report on each item your client cares about. FR/BAR Residential Contract

Who can inspect a seawall under the standard contract?

A licensed home inspector, or a person with a Florida license to repair and maintain the item. For a seawall, ask whether that license covers marine work, and bring in an engineer when the question is structural.

What if the online permit search shows nothing?

Treat it as a question, not an answer. Older permits may sit in paper files or under another parcel number. Ask the permit office and write down what you searched.

Can the seller's old report serve the buyer?

Check its date, who it was written for and what it covered. The buyer and their advisers can then decide whether an update is needed.

Should the agent suggest a credit amount?

Leave the number to written scopes and prices. Your job is to get the right questions answered before the deadline.

What if the wall looks unsafe during a showing?

Keep people back from the edge and tell the listing agent and the owner the same day. If anyone is in immediate danger, call 911.

Where do I find the seawall permit history?

Use the office that matches the parcel. For unincorporated Bay County, the county's Permit Search shows permits, documents and images by address or parcel number. Bay County Permit Search Dock and seawall permits carry the PRDC prefix. Bay County permit prefixes

In Gulf County, permit history comes through a public records request linked from the Building Department page. Gulf County Building Department

An open permit from a former owner is worth resolving, but Florida protects the buyer in one way. Local agencies may not deny a permit to, cite or fine an arm's-length buyer solely because a prior owner's permit was never closed. s. 553.79(17), F.S.

Gulf-front listings carry an extra disclosure

For property seaward of the coastal construction control line (CCCL), Florida requires a statement about coastal erosion and the regulation of rigid coastal protection structures, unless the buyer waives it in writing. s. 161.57, F.S.

Bay County's line follows the Gulf beaches from the Walton County line to the Gulf County line, with breaks at St. Andrews Pass and Tyndall. Rule 62B-26.024, F.A.C. Gulf County's line also runs along parts of St. Joseph Bay. Rule 62B-26.016, F.A.C.

A Gulf-front seawall is CCCL work, and the CCCL repair exemption specifically excludes seawalls. s. 161.053(11)(a), F.S. See the Gulf-front armoring guide.
